The Distributors Advantage Program Terms and Conditions
Introduction
These terms and conditions govern The Distributors Advantage Rewards Program for eligible Participating Retailers. Please read them carefully. All Terms and Conditions are subject to change at the discretion of The Distributors.
Each Advantage Rewards Retailer is bound by the following conditions of use.
Definitions
"Active Account" means a customer account that has had points rewarded for a period of six (6) months since the last loading of points to the account.
"Retailer" means the end user. This person orders their product from their nearest "The Distributors Warehouse" and will be awarded the Advantage Reward Dollars in this Program.
"Nominated Person" means the person within a Retailer that has signed documentation confirming their details and are eligible will earn Advantage Reward Dollars.
"Website" means the rewards website built and managed by Pinpoint for the purpose of providing information about The Distributors Advantage Rewards Program.
"Gift Card Website" means the website that is run and maintained by the Universal Gift Card servicer.
"Reward Dollars" means accumulated reward dollars that can be redeemed for prizes/rewards.
"Rewards" means products and services, including but not limited to personal computers, laptops, software, printers/scanners, digital cameras, home wares, brown goods, white goods, sporting equipment, airfares, accommodation, shopping vouchers and experiences.
"Participating Partners" means the 'sponsoring' suppliers that are sponsoring the rewards program. Purchases of these suppliers' products are being rewarded in the form of Advantage Reward Dollars to the Retailers.
"Inactive account" means a customer account that has not had points rewarded for a period of six (6) months since the last loading of points to the account.
Who Can Join
One nominated person only per Retail Outlet will be awarded Advantage Reward Dollars on their The Distributors Advantage Rewards Account. The nominated person within each retail outlet will not be eligible to earn Advantage Reward Dollars until all mandatory customer data including but not limited to first name, surname, email, company address and contact details and ABN is supplied to The Distributors.
The program is open to all non-national, non-corporate customers only. Retailers may receive Bonus Advantage Reward Dollars for promotional purposes. Advantage Reward Dollars will be awarded on the selected participating suppliers' products only. These Advantage Reward Dollars can then be used to purchase merchandise, gift cards, travel & accommodation and experiences.
Earning Advantage Reward Dollars
Advantage Reward Dollars will only be awarded for products ordered from participating manufacturers as promoted on selected products and these may change from time to time at the sole discretion of The Distributors.
The Distributors and The Distributors Warehouses may, at their absolute discretion, withhold Advantage Reward Dollars at any time. If the retailer is in breach of trading terms, The Distributors or The Distributors Warehouses may withdraw or cancel the value of any rewards from the nominated retailer's balance.
The Distributors and The Distributors Warehouses have the right to limit promotional order quantities to 'standard' wholesale purchase quantities.
Advantage Reward Dollars will be credited to a Retailers Advantage Rewards account within thirty (30) business days from the end of the proceeding earning month. If the Retailer has a query over the amount of dollars earned on their The Distributors Advantage account they have 30 days from date of the email statement to dispute this amount. After this date the dollars are deemed correct.
Eligibility to redeem will be suspended if no purchases are made within a three (3) month period and will only be reactivated when an eliglible customer earns rewards/points in the following three months. Where there is no earning activity on the account for a period of six (3) months the account will be closed.
From time to time, Retailers may receive Bonus Advantage Reward Dollars for promotions on products purchased from the participating suppliers.
The Distributors Advantage Rewards
Gift Vouchers, Electrical Goods, Homewares and Travel.
Rewards can be claimed at any time on an active account for a period of twelve (12) months after the rewards account has been loaded with these points.
In the instance that a Retailer closes their business they must inform their Sales Representative in writing. No more Advantage Reward Dollars will be awarded to that account as of the first day of the following calendar month and the balance of the account must be redeemed within 30 days of sale of business or points will be forfeited.
Once The Distributors Advantage reward dollars have been credited to the Retailer's rewards balance, the retailer may redeem their rewards on-line at any time by visiting The Distributors website www.the-distributors.com.au. Rewards can be claimed at any time for a period of twelve (12) months after the rewards account has been loaded with these points. Fees and charges incurred through selected redemption items will be deducted from the customer rewards account at the time of redemption.
In the instance that a Retailer's name, address details or email address changes, then the Retailer is required to notify their Sales Representative. Should a retail outlet be sold, closed or become bankrupt then the retailer is required to notify their Sales Representative in writing.
In the instance that a Retailer closes their business they must inform their Sales Representative in writing. No more Advantage Reward Dollars will be awarded to that account as of the first day of the following calendar month.
Statements
An e-mailed statement will be issued monthly. It will show all Advantage Reward Dollars earned up to and including the last calendar day of the prior month, all Bonus Advantage Reward Dollars, Redeemed Advantage Reward Dollars and an Advantage Reward Dollars balance for each Advantage Rewards Account.
Queries about the Statement should be made by email to the published The Distributors Advantage Rewards email address or in writing to The Distributors with all supporting documentation.
Missing Reward Dollar requests must mailed to the Distributors Advantage Rewards program, Locked Bag, 2018, North Ryde BC, NSW 1670, and be accompanied by a copy of the relevant invoice from The Distributors Warehouse within 30 days from the date the monthly statement has been issued. After this date the dollars are deemed correct.
An Advantage Rewards balance can be obtained from your local representative of The Distributors when placing orders.
Leaving the Advantage Rewards Program
If a Retailer chooses to resign/wishes to opt out from the Program they must advise The Distributors in writing and give 30 days notice to The Distributors Sales representative.
If the nominated Retailer within a retail outlet leaves the retail outlet then they must advise their sales representative. The account will then either be updated with the new details or closed. If it is closed the Retailer will not earn any further Advantage Reward Dollars.
If a Retailer of The Distributors Advantage Rewards Program dies, the executor of the estate must inform The Distributors in writing. The Distributors will inform Pinpoint in writing. All DADs will be forfeited.
If the nominated Retailer within a retail outlet leaves the retail outlet then they must advise their sales representative. The account will then either be updated with the new details or closed. If it is closed the Retailer will not earn any further Advantage Reward Dollars and the balance of the account must be redeemed within 30 days of sale of business or points will be forfeited.
Tax Liability
It is the responsibility of the retailer to seek independent professional taxation advice in relation to the taxation effects arising from membership of and participation in The Distributors Advantage Rewards Program. In addition, the retailer is responsible for any taxation liability (including GST) or other government fees and charges relating to membership.
Program Alterations
Changes to Terms and Conditions !V From time to time The Distributors may vary the Terms and Conditions without prior notification. The Distributors will provide Retailers with 7 days' notification of material changes to the Terms and Conditions on this website.
Withholding, Cancellation and Adjustment of Advantage Reward Dollars
The Distributors reserve the right to adjust your total Advantage Reward Dollars if your points have been incorrectly credited or debited for any reason.
The Distributors and The Distributors Warehouses may, at their absolute discretion, withhold Advantage Reward Dollars at any time. If the retailer is in breach of trading terms, the Distributors or The Distributors Warehouses may withdraw or cancel the value of any rewards from the retailer's balance. The Distributors and The Distributors Warehouses are not liable for any loss or damage suffered resulting from withholding, cancellation or withdrawals made by The Distributors or The Distributors Warehouses in accordance with these terms and conditions.
The Distributors reserve the right to expire non-redeemed points/reward dollars twenty-four (24) months after the date of addition to an account. Distributors Advantage are not obligated to provide notification prior to expiring points.
The Distributors reserve the right to cancel a customer membership and expire remaining points immediately in the account when the account is deemed inactive i.e. no rewards/dollars added to the account for a period of six (6) months. Distributors Advantage are not obligated to provide notification prior to expiring points.
The Distributors reserve the right to cease the program at any given time, allowing participating active customers a period of thirty (30) days after the closure of the program, the opportunity to redeem the final Advantage Reward Dollars on their account.
The Distributors reserves the right to change the Reward Point Value of catalogue items without any notice
The Distributors reserves the right at their absolute discretion at any time to exclude any customer from inclusion in the Reward Program or to cancel the registration of any customer.
The Distributors is not responsible for Rewards received under a Rewards Program, any death or injury, loss or consequential loss or damage from a Reward or the loss, theft or destruction of a Reward or a Reward voucher.
Rights under the Trade Practices Act and warranties implied by law which cannot be excluded, subject to these rights and implied warranties, The Distributors provide no warranty with respect to the quality of the Rewards or their suitability or fitness for any purpose.
Any dispute concerning goods or services received as a Reward item shall be settled between the Rewards Provider who supplied the goods or services.
The Distributors reserves the right to change these Conditions of Use at any time.
Failure to enforce a particular Condition of Use does not constitute a waiver of that term or condition by The Distributors.
The Distributors may exercise any right, power or remedy in this document at its discretion and separately or concurrently with any other right, power or remedy.
Disputes
Any disputes, including those relating to current Advantage Reward Dollars earned shall be handled by The Distributors in accordance with The Distributors' Dispute Resolution Policy. Any disputes, including those relating to current Advantage Reward Dollars earned should be directed in writing to The Distributors Advantage Rewards Program, Locked Bag, 2018, North Ryde BC, NSW 1670.
Privacy
Eligible Members, unless otherwise advised by the qualifying customer consents to the information which they submit form being entered into a database and for The Distributors to use this information for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the qualifying customer.
