Terms and Conditions

Effective 1 January 2013

1. Introduction

These Terms and Conditions govern the L'Oréal Salon Rewards program. Please read them carefully. All Terms and Conditions are subject to change at the discretion of L'Oréal Australia Pty Ltd.

Each L'Oréal Australia Pty Ltd customer who participates in L'Oréal Salon Rewards (Member) is bound by the following conditions of use.

2. Definitions

In these Terms and Conditions:

L'Oréal, we or us means L'Oréal Australia Pty Ltd, whose registered office is 564 St Kilda Road, Melbourne, VIC, 3004.

L'Oréal Salon Rewards program means the system of allocating and redeeming L'Oréal Salon Rewards Points as described in and governed by these Terms and Conditions

L'Oréal Salon Rewards Points means Points, which may include Bonus Points, that is the currency earned by Members that can be used to redeem various Rewards on offer by the program.

L'Oréal Salon Rewards Account or Rewards Account is the loyalty account set-up for each Member to facilitate participation in the L'Oréal Salon Rewards program including the tracking of Reward Points and redemptions.

L'Oréal Salon Rewards Catalogue means the list of products, goods and services for which Reward Points maybe redeemed.

L'Oréal Salon Rewards Centre means the customer service centre established to handle in the first instance all queries relating to program, reward redemption or issues relating to the provision of the Rewards.

Bonus Points means Points offered by L'Oréal in addition to the normal L'Oréal Salon Rewards Points

Business Day means a weekday including local public holidays but excluding holidays observed on a national basis.

Eligible Spend means purchases of products directly from L'Oréal within the following brands – L'Oréal Professionel, Redken, Kérastase Paris and Pureology

Forfeited Points means any L'Oréal Salon Rewards Points, which the member is no longer entitled to claim, pursuant to these Terms and Conditions.

Member means the person within a Salon whose name appears on the current account details held by L'Oréal, that has been assessed as eligible to participate in the L'Oréal Salon Rewards program and who has agreed to be bound by these Terms and Conditions.

Points Plus Pay means a method by which Members can use a valid credit card to pay for the remainder of a Reward, where they have insufficient points or where they do not wish to spend all their L'Oréal Salon Rewards Points.

Pureology Threshold means the minimum net purchase value of AUD4,000 (excluding GST) for a particular calendar year required in order to earn L’Oréal Salon Rewards Points.

Reward/s refers to the range of merchandise, unique experiences, vouchers, gift cards, travel and events on offer to Members of L'Oréal Salon Rewards for redemption.

Rewards Statement or Statement means the monthly statement listing all transactions on the L'Oréal Salon Rewards Account up to and including the last calendar day of the month.

Redken Threshold means the minimum net purchase value of AUD20,000 (excluding GST) for a particular calendar year required in order to earn L’Oréal Salon Rewards Points.

Reward Value means the total number L'Oréal Salon Rewards Points required to be redeemed for any particular Reward.

Rewards Website means the rewards website built and established for the purpose of providing information about the L'Oréal Salon Rewards program located at www.loreal-salon-rewards.com.au.

Terms and Conditions means this document and any schedules as amended from time to time.

3. Who Can Join

Customers of L'Oréal Australia Pty Ltd will be invited to join L'Oréal Salon Rewards. L'Oréal will qualify via its specific brands and auto-enrol all customers who are eligible to participate.

Redken Customers of L’Oréal are subject to the Redken Threshold. Pureology Customers of L’Oréal are subject to the Pureology Threshold.

4. Earning L'Oréal Salon Rewards Points

L’Oréal Salon Rewards Points will be earned for Kérastase Paris, L’Oréal Professionel, Pureology and Redken products bought directly from L’Oréal and paid for within trading terms. Products and Terms may change from time to time at the sole discretion of L’Oréal.

L’Oréal Salon Rewards Points are earned at rate of 1 point per dollar of net sales of eligible spend.  Products supplied by other distributors will not be eligible to earn Reward Points.  Products purchased must be for use by the member or for sale through their own retail channels. No product may be onsold by the member to a wholesaler or another retailer.

Points will be earned as whole points only – no fractional points. Sales amounts up to $0.99 will be rounded down to the nearest whole dollar before Points are applied.

Members may also receive Bonus Points for the purchase of promotional products or undertaking promotional activities.

L’Oréal may refuse to award Points to Members at its sole discretion where it has reasonable grounds to suspect that the Member is acting fraudulently or is abusing the L’Oréal Salon Rewards program.

L’Oréal may, at their absolute discretion, withhold L’Oréal Salon Rewards Points at any time. If a Member is in breach of trading terms, L’Oréal may withdraw or cancel the value of any rewards from the Member’s balance.

L’Oréal reserves the right to limit promotional order quantities to 'standard' wholesale purchase quantities.

L’Oréal Salon Rewards Points will be credited to a Members L’Oréal Salon Rewards account within thirty (30) Business Days from the end of the month in which they are earned. Members will be sent a Rewards Statement (via email) in order for them to track their Points balance. If a Member has a query regarding the amount of Points earned in their L’Oréal Salon Rewards account they have 30 days from date of their Rewards Statement to dispute this amount. After this date the Points are deemed correct.

Points are earned on eligible spend made from 1 January 2013.   

Points are valid for 2 years from the date they are credited to the Member’s loyalty account.  Points unredeemed after this period will be expired.

5. Using L'Oréal Salon Rewards Points / Redemptions

L’Oréal Salon Rewards Points can be used to purchase Rewards, including but not limited to Gift Cards, Vouchers, Merchandise, Electrical Goods, Home Wares, Travel and Unique Experiences.

Once L’Oréal Salon Rewards Points have been credited to the Members Account, they can be redeemed when the Member has:

  1. Successfully activated in the Rewards website at www.loreal-salon-rewards.com.au
  2. The Member has sufficient Points or opts to use Points Plus Pay; and
  3. The Member is eligible to redeem according to the rules as outlined elsewhere in these Terms and Conditions.

Rewards can be claimed after the receipt of the 1st Rewards Statement (February 2013). Fees and charges incurred through selected redemption items will be deducted from the customer rewards account at the time of redemption.

At the time of redemption, the Member can nominate an address to which their Reward will be delivered. This address will be used specifically for that Reward and not saved to the Member account.

Where a Member has more than one (1) L’Oréal account for the purchase of products, they may “link” their accounts effectively pooling their L’Oréal Salon Rewards Points to claim one or more Rewards at the one time.

L’Oréal and its related parties shall not be responsible for any loss caused to a Member(s) as the result of the fraudulent redemption of L’Oréal Salon Rewards Points by an unauthorised person where such redemption has been accepted on the basis of the applicable identification process.

L’Oréal has the right and discretion to change the types of Rewards offered or the number of L’Oréal Salon Rewards Points required to obtain any Rewards in the L’Oréal Salon Rewards program and will not be responsible for Rewards no longer being available.

The L’Oréal Salon Rewards Points detailed in the L’Oréal Salon Rewards marketing collateral are indicative at the time of publication and are subject to alteration at any time.

Superseded products shown in L’Oréal Salon Rewards collateral or on the Rewards Website may be replaced with current Products and the relevant Reward Value may be adjusted accordingly. Product models available will be confirmed at the time of ordering Rewards.

Rewards cannot be changed, cancelled or exchanged to obtain a re-credit of L’Oréal Salon Rewards Points. Products can only be returned to the L’Oréal Salon Rewards if they are faulty, and L’Oréal Salon Rewards Points will only be re-credited on receipt of the faulty Product.

Members have the option to “top up” their L’Oréal Salon Rewards Points using Points Plus Pay. Members do not need to ‘spend’ all their available L’Oréal Salon Rewards Points when using Points Plus Pay.

Reward Values will be confirmed at the time of ordering Rewards.

Most Rewards will be delivered to the nominated address within 28 days of receipt of order.

L’Oréal Salon Rewards Points for redemptions will be deducted in the chronological order in which they have been earned, i.e. the oldest L’Oréal Salon Rewards Points are used first.

Freight and delivery costs for product Rewards are included in the points value required for redemption.

L’Oréal Salon Rewards Points may not be redeemed in payment of an L’Oréal Account.

L’Oréal Salon Rewards Points may not be purchased, and are only accumulated in the manner set out in these Terms and Conditions.

6. Statements

A Rewards Statement will be issued monthly via email and will show the L'Oréal Salon Rewards Points balance for the Member's loyalty account, including L'Oréal Salon Rewards Points earned up to and including the last calendar day of the prior month, all Bonus Points earned and L'Oréal Salon Rewards Points redeemed.

Queries about the Statement should be made in writing via email to info@loreal-salon-rewards.com.au or mail to the L'Oréal Salon Rewards program, PO Box 444, Balmain NSW 2041 with all supporting documentation. All missing points claims must be made within 30 days from the date the monthly statement has been issued. After this date the Points are deemed correct.

Marketing material may be delivered to members with their Statements.

7. Leaving the L'Oréal Salon Rewards program

Membership of the program will terminate automatically on the closure of member's trading account with L'Oréal. Points accrued but not redeemed at the time of termination will be forfeited.

If a Member chooses to resign/wishes to opt out from the L'Oréal Salon Rewards program they must advise L'Oréal in writing via L'Oréal Salon Rewards, PO Box 444, Balmain NSW 2041. Upon receipt of notification, the Member's loyalty account will be closed, no further Points will be earned and all Points in the loyalty Account will be forfeited.

8. Change of Circumstance

Where there is a change in the partnership or ownership arrangements to a Member’s Company a new L’Oréal Account is issued and the current L’Oréal Salon Rewards Account will be closed. Members will have 3 months to redeem the L’Oréal Salon Rewards Points or transfer the L’Oréal Salon Rewards Points to another L’Oréal Salon Rewards Account from the date of the change. Any unredeemed L’Oréal Salon Rewards Points will become Forfeited Points.

Should a Members business be sold, closed or become bankrupt then the Member is required to notify L’Oréal in writing. Upon receipt of notification, the Member’s loyalty account will be closed, no further Points will be earned and all Points in the Rewards Account will be forfeited.

Should a Member die, the next of kin or estate should inform L’Oréal in writing. Upon receipt of notification, the Member’s Rewards Account will be closed, no further Points will be earned and all Points in the Rewards Account will be forfeited.

In the instance that a Members Business name, address details or contact details changes, then the Member is required to notify L’Oréal and adjustments will be made to the Member’s Rewards Account.

9. Transfer of Membership

Members cannot transfer membership of L'Oréal Salon Rewards to any other person or entity.

10. Tax Liability

It is the responsibility of the Member to seek independent professional taxation advice in relation to the taxation effects arising from membership of and participation in the L'Oréal Salon Rewards program. In addition, the Member is responsible for any taxation liability (including GST) or other government fees and charges relating to membership.

11. Termination of the Program

L'Oréal reserves the right to terminate the program upon giving reasonable notice to the Member. If L'Oréal Salon Rewards is terminated, Members must redeem any unredeemed L'Oréal Salon Rewards Points within two (2) months of the termination of the program.

12. Program Alterations

Changes to Terms and Conditions – from time to time L'Oréal may vary the Terms and Conditions without prior notification. L'Oréal will provide Members with 7 days' notification of material changes to the Terms and Conditions on the Rewards Website.

13. Withholding, Cancellation and Adjustment of L'Oréal Salon Rewards Points

L'Oréal reserve the right to adjust a Members total L'Oréal Salon Rewards Points if your points have been incorrectly credited or debited for any reason.

L’Oréal may, at their absolute discretion, withhold L’Oréal Salon Rewards Points at any time. If the Member is in breach of trading terms, including not achieving the Redken or Pureology Threshold (whichever is applicable), L’Oréal may withdraw or cancel the value of any rewards from the Member's balance for that calendar year. L’Oréal is not liable for any loss or damage suffered resulting from withholding, cancellation or withdrawals made by L’Oréal in accordance with these terms and conditions.

14. L'Oréal reserves the right to

L'Oréal reserves the right to change the Reward Point Value of catalogue items without any notice.

L'Oréal reserves the right at their absolute discretion at any time to exclude any customer from inclusion in the Reward Program or to cancel the registration of any customer.

L'Oréal is not responsible for Rewards received under a Rewards Program, any death or injury, loss or consequential loss or damage from a Reward or the loss, theft or destruction of a Reward or a Reward voucher.

Rights under the Trade Practices Act and warranties implied by law, which cannot be excluded, subject to these rights and implied warranties, L'Oréal provide no warranty with respect to the quality of the Rewards or their suitability or fitness for any purpose.

Any dispute concerning goods or services received as a Reward shall be settled between the Rewards Provider who supplied the goods or services.

L'Oréal reserves the right to change these Conditions of Use at any time.

Failure to enforce a particular Condition of Use does not constitute a waiver of that term or condition by L'Oréal.

L'Oréal may exercise any right, power or remedy in this document at its discretion and separately or concurrently with any other right, power or remedy.

15. Responsibilities

To the maximum extent permitted by law, L’Oréal makes no warranties or representation, either expressed or implied, and expressly disclaims any or all liability (including consequential damages) with respect to type, quantity or fitness of good and services provided through the L’Oréal Salon Rewards program. To the extent that L’Oréal may be liable for goods and services provided through the L’Oréal Salon Rewards program, its liability is limited to its obligations under the Competition and Consumer Act 2010 (Cth).

16. Disputes

Any disputes, including those relating to current L'Oréal Salon Rewards Points earned will be resolved at the sole discretion of L'Oréal. Any disputes, including those relating to L'Oréal Salon Rewards Points earned should be directed in writing to via email to info@loreal-salon-rewards.com.au or mail to the L'Oréal Salon Rewards, PO Box 444, Balmain NSW 2041.

17. Privacy

Members, unless otherwise advised, consents to the information which they submit form being entered into a database and for L'Oréal to use this information for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the qualifying customer. The L'Oréal Salon Rewards program is operated in Australia. Given that we are an international business, our use of your information necessarily involves the transmission of data (including Personal Information) to countries outside of Australia. By participating in the program you consent to the transfer of your Personal Information to recipients that are located in the following countries: New Zealand, Asia, the USA, Canada, and countries in the EU.
