Terms and Conditions

  1. Introduction

    These Terms and Conditions govern the Brickworks Platinum Rewards™ program. Please read them carefully. All Terms and Conditions are subject to change at the discretion of Brickworks Limited.

    Each Brickworks Customer who participates in Brickworks Platinum Rewards™ (Member) is bound by the following conditions of use.

  2. Definitions

    In these Terms and Conditions:

    Bonus Points means Brickworks Platinum Rewards™ Points offered by Brickworks in addition to the normal Brickworks Platinum Rewards™ Points

    Brickworks, we or us means Brickworks Limited and participating group companies including Austral Bricks, Bristile Roofing (Excludes Bristile Roofing Westcoast) or Austral Masonry.

    Brickworks Platinum Rewards™ Account or Account is the loyalty account set-up for each Member to facilitate participation in the Brickworks Platinum Rewards™ program including the tracking Points and redemptions.

    Brickworks Platinum Rewards™ Catalogue means the list of products, goods and services for which Points may be redeemed from time to time

    Brickworks Platinum Rewards™ Centre means the telephone call telephone established to handle in the first instance all queries relating to program, reward redemption or issues relating to the provision of the Rewards.

    Brickworks Platinum Rewards™ Points means Points, which may include Bonus Points, that is the currency earned by Members that can be used to redeem various Rewards on offer by the program.

    Brickworks Platinum Rewards™ Program means the system of allocating and redeeming Brickworks Platinum Rewards™ Points as described in and governed by these Terms and Conditions

    Brickworks Product means any product purchased from Austral Bricks, Bristile Roofing (Excludes Bristile Roofing Westcoast) or Austral Masonry by means of a Company Account.

    Business Day means a weekday including local public holidays but excluding holidays observed on a national basis.

    Eligible Spend means purchases of Brickworks products made from by Members that earn Brickworks Platinum Rewards™ points during the duration of the program.

    Forfeited Points means any Brickworks Platinum Rewards™ Points, which the member is no longer entitled to claim, pursuant to these Terms and Conditions.

    Member means a customer of Brickworks that we assess to be eligible to participate in the Brickworks Platinum Rewards™ program and who has agreed to be bound by these Terms and Conditions.

    Points Plus Pay means a method by which Members can use a valid credit card to pay for the remainder of a Reward, where they have insufficient points or where they do not wish to spend all their Brickworks Platinum Rewards™ Points.

    Rewards refers to a choice of rewards on offer to Members of Brickworks Platinum Rewards™ including travel, a range of merchandise, unique experiences, vouchers and gift cards.

    Rewards Statement or Statement means the monthly statement listing all transactions on the Brickworks Platinum Rewards™ Account up to and including the last calendar day of the month.

    Reward Value means the total number Brickworks Platinum Rewards™ Points required to be redeemed for any particular Reward. Rewards Website means the rewards website built and established for the purpose of providing information about the Brickworks Platinum Rewards™ Program located at www.brickworksrewards.com.au.

    Terms and Conditions means this document and any schedules as amended from time to time.

  3. Who Can Join

    Brickworks Limited will qualify and auto-enrol all customers who are eligible to participate in Brickworks Platinum Rewards™.

  4. Earning Brickworks Platinum Rewards™ Points

    Brickworks Platinum Rewards™ Points will only be earned for products bought from participating Brickworks Group Companies - Austral Bricks, Bristile Roofing (Excludes Bristile Roofing Westcoast) or Austral Masonry. This may change from time to time at the sole discretion of Brickworks Limited.

    Brickworks Platinum Rewards™ Points are earned at rate of 1 point per dollar of eligible spend.

    Points will be earned as whole points only - no fractional points. Sales amounts up to $0.49 will be rounded down to the nearest whole dollar and sales over $0.50 will be rounded up to the nearest whole dollar before Points are applied.

    Members may also receive Bonus Points for the purchase of promotional products or undertaking promotional activities.

    Brickworks may refuse to award Points to Members at its sole discretion where it has reasonable grounds to suspect that the Member is acting fraudulently or is abusing the Brickworks Platinum Rewards™ program.

    Brickworks may, at their absolute discretion, withhold Brickworks Platinum Rewards™ Points at any time. If a Member is in breach of trading terms, Brickworks may withdraw or cancel the value of any rewards from the Members balance.

    Brickworks have the right to limit promotional order quantities to 'standard' wholesale purchase quantities.

    Brickworks Platinum Rewards™ Points will be credited to a Members Brickworks Platinum Rewards™ account within thirty (30) business days from the end of the month in which they are earned. Members will be sent a Rewards Statement in order for them to track their Points balance. This will initially be by Mail and then by email. If a Member has a query regarding the amount of Points earned in their Brickworks Platinum Rewards™ account they have 30 days from date of their Rewards Statement to dispute this amount. After this date the Points are deemed correct.

    Points are earned on eligible purchases made after 1 September 2009.

    Bristile Roofing (Excludes Bristile Roofing Westcoast) Supply and Fix Customers earn Platinum Rewards Points at a rate of 1/2 a point for every dollar spent.

  5. Using Brickworks Platinum Rewards™ Points / Redemptions

    Brickworks Platinum Rewards™ points can be used to purchase Rewards, including but not limited to Gift Vouchers, Merchandise. Electrical Goods, Home Wares, Travel and Unique Experiences.

    Once Brickworks Platinum Rewards™ points have been credited to the Members Account, they can be redeemed when the Member has:

    1. Successfully activated in the Rewards website at www.brickworksrewards.com.au or identified themselves to Brickworks Customer Service (1300 407 238) as a Member; 2. The Member has sufficient Points or opts to use Points Plus Pay; and 3. The Member is eligible to redeem according to the rules as outlined elsewhere in these Terms and Conditions.

    Rewards can be claimed after the receipt of the first Rewards Statement. Fees and charges incurred through selected redemption items will be deducted from the customer rewards account at the time of redemption At the time of redemption, the Member can nominate an address to which their Reward will be delivered. This address will be used specifically for that Reward and not saved to the Member account.

    Where a Member has more than one (1) Brickworks Account, they may "pool" the Brickworks Platinum Rewards™ Points from each Brickworks Account to claim one or more Rewards at the one time.

    Where there is more than one Member to the Brickworks Account all Members related to the account are able to redeem all or some of the Brickworks Platinum Rewards™ Points.

    Brickworks and its related parties shall not be responsible for any loss caused to a Member(s) as the result of the fraudulent redemption of Brickworks Platinum Rewards™ Points by an unauthorised person where such redemption has been accepted on the basis of the applicable identification process.

    Brickworks has the right and discretion to change the types of Rewards offered or the number of Brickworks Platinum Rewards™ Points required to obtain any Rewards in the Brickworks Platinum Rewards™ Rewards Program and will not be responsible for Rewards no longer being available to members wishing to redeem Brickworks Platinum Rewards™ Points for them.

    The Brickworks Platinum Rewards™ Points detailed on the Brickworks Platinum Rewards™ Rewards website are indicative at the time of redemption and are subject to alteration at any time.

    Superseded Products shown on the Brickworks Platinum Rewards™ Rewards Website maybe replaced with current Products and the relevant Reward Value may be adjusted accordingly. Product models available will be confirmed at the time of ordering Rewards.

    Rewards cannot be changed, cancelled or exchanged to obtain a re-credit of Brickworks Platinum Rewards™ Points. Products can only be returned to the Brickworks Platinum Rewards™ Customer Service Centre if they are faulty, and Brickworks Platinum Rewards™ Points will only be re-credited on receipt of the faulty Product.

    Members have the option to "top up" their Brickworks Platinum Rewards™ Points using Points Plus Pay. Members do not need to 'spend' all their available Brickworks Platinum Rewards™ Points when using Points Plus Pay.

    Reward Values will be confirmed at the time of ordering Rewards.

    Most Rewards will be delivered to the nominated address within 28 days of receipt of order.

    Brickworks Platinum Rewards™ Points for redemptions will be deducted in the chronological order in which they have been earned, i.e. the oldest Brickworks Platinum Rewards™ Points are used first.

    Brickworks Platinum Rewards™ Points may not be redeemed in payment of a Brickworks Account.

    Brickworks Platinum Rewards™ Points may not be purchased, and are only accumulated in the manner set out in these Terms and Conditions.

  6. Points Expiry

    Points are valid for 2 years from the date in which they are credited to the Member's loyalty account. Points expiry will be conducted from 1st February 2014. All points that were earned before the 1st February 2012 and are unused will not expire until the 1st February 2014.

  7. Statements

    A Rewards Statement will be issued monthly and will show all Brickworks Platinum Rewards™ points earned up to and including the last calendar day of the prior month, all Promotional Points earned, Brickworks Platinum Rewards™ points redeemed and a Brickworks Platinum Rewards™ points balance for the Member's loyalty account.

    Queries about the Statement should be made in writing via email to info@Brickworksrewards.com.au or mail to the Brickworks Platinum Rewards™ Program, PO Box 444, Balmain NSW 2041 with all supporting documentation. All missing points claims must be made within 30 days from the date the monthly statement has been issued. After this date the Points are deemed correct. Marketing material may be delivered to members with their Statements.

  8. Leaving the Brickworks Platinum Rewards™ Program

    If a Member chooses to resign/wishes to opt out from the Brickworks Platinum Rewards™ program they must advise Brickworks in writing via Brickworks Platinum Rewards™, PO Box 444, Balmain NSW 2041. Upon receipt of notification, the Member's loyalty account will be closed, no further Points will be earned and all Points in the loyalty Account will be forfeited.

    If a Member of the Brickworks Platinum Rewards™ program dies, the executor of the estate must inform Brickworks in writing. Upon receipt of notification, the Member's loyalty account will be closed, no further Points will be earned and all Points in the loyalty Account will be forfeited.

  9. Change of Circumstance

    Where there is a change in the partnership or ownership arrangements to a Member's Company a new Brickworks Account is issued and the current Brickworks Platinum Rewards™ Account will be closed. Members will have 3 months to redeem the Brickworks Platinum Rewards™ Points or transfer the Brickworks Platinum Rewards™ Points to another Brickworks Platinum Rewards™ Account from the date of the change. Any unredeemed or un-transferred Brickworks Platinum Rewards™ Points will become Forfeited Points.

    Should a Members business be sold, closed or become bankrupt then the Member is required to notify Brickworks in writing. Upon receipt of notification, the Member's loyalty account will be closed, no further Points will be earned and all Points in the Rewards Account will be forfeited.

    Should a Member die, the next of kin or estate should inform Brickworks in writing. Upon receipt of notification, the Member's Rewards Account will be closed, no further Points will be earned and all Points in the Rewards Account will be forfeited. In the instance that a Members Business name, address details or contact details changes, then the Member is required to notify Brickworks and adjustments will be made to the members Rewards Account.

  10. Transfer of Membership

    Members cannot transfer membership of Brickworks Platinum Rewards™ to any other person or entity.

  11. Tax Liability

    It is the responsibility of the Member to seek independent professional taxation advice in relation to the taxation effects arising from membership of and participation in the Brickworks Platinum Rewards™ program. In addition, the Member is responsible for any taxation liability (including GST) or other government fees and charges relating to membership.

  12. Termination of the Program

    Brickworks reserves the right to terminate the program upon giving reasonable notice to the Member. If Brickworks Platinum Rewards™ is terminated, Members must redeem any unredeemed Brickworks Platinum Rewards™ Points within two (2) months of the termination of the program.

  13. Program Alterations

    Changes to Terms and Conditions - from time to time Brickworks may vary the Terms and Conditions without prior notification. Brickworks will provide Members with 7 days' notification of material changes to the Terms and Conditions on the Rewards Website.

  14. Withholding, Cancellation and Adjustment of Brickworks Platinum Rewards™ Points

    Brickworks reserve the right to adjust a Members total Brickworks Platinum Rewards™points if your points have been incorrectly credited or debited for any reason. Brickworks may, at their absolute discretion, withhold Brickworks Platinum Rewards™points at any time. If the Member is in breach of trading terms, Brickworks may withdraw or cancel the value of any rewards from the Member's balance. Brickworks are not liable for any loss or damage suffered resulting from withholding, cancellation or withdrawals made by Brickworks in accordance with these terms and conditions.

    Brickworks reserve the right to forfeit all points that remain unredeemed as at 30th November 2011.

  15. Brickworks reserves the right to

    Brickworks reserve the right to change the Reward Point Value of catalogue items without any notice.

    Brickworks reserve the right at their absolute discretion at any time to exclude any customer from inclusion in the Reward Program or to cancel the registration of any customer.

    Brickworks is not responsible for Rewards received under a Rewards Program, any death or injury, loss or consequential loss or damage from a Reward or the loss, theft or destruction of a Reward or a Reward voucher.

    Rights under the Trade Practices Act and warranties implied by law, which cannot be excluded, subject to these rights and implied warranties, Brickworks provide no warranty with respect to the quality of the Rewards or their suitability or fitness for any purpose.

    Any dispute concerning goods or services received as a Reward shall be settled between the Rewards Provider who supplied the goods or services.

    Brickworks reserve the right to change these Conditions of Use at any time.

    Failure to enforce a particular Condition of Use does not constitute a waiver of that term or condition by Brickworks.

    Brickworks may exercise any right, power or remedy in this document at its discretion and separately or concurrently with any other right, power or remedy.

  16. Responsibilities

    To the maximum extent permitted by law, Brickworks makes no warranties or representation, either expressed or implied, and expressly disclaims any or all liability (including consequential damages) with respect to type, quantity or fitness of good and services provided through Brickworks Platinum Rewards™. To the extent that Brickworks may be liable for goods and services provided through the Brickworks Platinum Rewards™, its liability is limited to its obligations under the Trade Practices Act 1974.

  17. Disputes

    Any disputes, including those relating to current Brickworks Platinum Rewards™ Points earned will be resolved at the sole discretion of Brickworks. Any disputes, including those relating to Brickworks Platinum Rewards™ Points earned should be directed in writing via email to info@brickworksrewards.com.au or mail to the Brickworks Platinum Rewards™, PO Box 444, Balmain NSW 2041.

  18. Privacy

    Members, unless otherwise advised, consents to the information which they submit form being entered into a database and for Brickworks to use this information for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the qualifying customer.
